Planning Permisson : Permitted Development

Permitted Development

Under new regulations that came into effect on the 1st October 2008, garden rooms, offices, studios and lodges are considered to be , NOT requiring planning permission, subject to a number of limits and conditions.

If you can answer "No" to all of the following four questions, your new garden room, office, studio or lodge will NOT require planning permission:

If you answered "No" to all of the above questions, then your garden room, office, studio, lodge or building may be built under permitted development, subject to the secondary limits and conditions detailed below.

Primary Limits and Condition

Permitted Development

Will the garden building stand forward of the principal elevation of your house, fronting the highway?
Will the garden building along with other buildings and additions, occupy more than half the area of land around the original house? (When it was first built or as it stood on 1st July 1948)
Will the garden building be built at the side of your house, on land designated as: a) A National Park b) The Broads c) As Area of Outstanding Natural Beauty d)

A Conservation Area or e) A World Heritage Site?
Will the garden building be located within the curtilage of a listed building?

Secondary Limits and Conditions


Garden buildings with a maximum overall height over 2.5 metres are considered permitted development so long as they are located 2 metres from any boundaries and subject to:

Apex or Duel Pitched Roof
A garden building with an apex or dual pitched roof must have an eaves height of no more than 2.5m and a maximum overall ridge height of no more than 4m.

Flat of Single Pitched Roof
A garden building with a flat or single pitched roof must have an eaves height of no more than 2.5m and a maximum overall height of no more than 3m.

Low Flat or Low Single Pitched Roof
A garden building with a low flat or low single pitched roof with a maximum overall height of 2.5m are considered permitted development and can be located within 2 metres of any boundaries.

If planning permission is required Oeco can offer its customers a full planning service. With our extensive planning experience, over many years, we are able to help with your planning application. Please note there are additional fees involved for this service.

Building Regulations
The rules governing building regulations for garden buildings are as follows:

  1. Less than 15m2 - Building regulations will not normally apply.
  2. Between 15m2 and 30m2 - Building regulations will not normally apply, providing that the building is either at least 1m from any boundary or is constructed of substantially non-combustible materials.
  3. In all cases, building regulations will be required if the building contains any sleeping accommodation.

Important
As you can see from the above, garden buildings up to an internal floor area of 30 square metres are generally exempt from building regulations (Except when the structure is to be used for sleeping accommodation) This leads many garden room companies to claim their products "comply with current building regulations" when in reality what they mean is "our buildings do not have to comply with building regulations". Obviously it is much easier and cheaper for a company to build a garden building that does not comply with the current building regulations.

Garden rooms, offices, studios, lodges and buildings that are not built to building regulations will tend to have thin walls, floors, ceiling, minimal insulation (if any!), no air flow cavities, no vapour barriers or breathing membranes. Purchasing a garden building which does not comply with the latest building regulations will cost you much more in the long term. They will be more expensive to heat, minimal insulation and no air flow will result in moisture entering the structure - often reducing the life of the actual structure and damaging internal contents. The room will sweat in the summer months and be uninhabitable during the winter. It is fairly common for people to spend the same amount purchasing a garden building which is not built to building regulations than to purchase one that is.

Building regulations are concerned with how a structure is designed, built and insulated. For a truly all year round habitable outdoor building it has to be designed, built and insulated to at least the same exacting quality and standards as a modern house.

Oeco garden buildings are constructed using materials which exceed the current building regulations - After all a garden building is an extension to your main home and we know you would much rather use the room all year round whatever the climate!

Inside all our garden rooms, offices and studios you will find traditional plaster boarded and skimmed walls and ceiling. A professionally plastered interior gives a warm, elegant surface finish and will also help with sound insulation, fire resistance and improved energy efficiency. For centuries, the benefits of plaster have been highlighted. It is now widely recognized as a harmless material according to health regulations and also environmentally-friendly. Plaster is made from mineral gypsum and water. It does not need glues, solvent or any product noxious to people.

Once your walls and ceiling have been plastered they will need to fully dry out before painting - please allow at least a week for the plaster to completely

dry. An optional painting and decorating service is available where we can return and completely decorate the internal walls and ceiling. We can apply 2 coats of white matt emulsion paint to the walls and ceiling.

Recommended Internal Paint:
A top quality, high opacity matt emulsion, for use on all interior walls and ceiling surfaces, particularly plasterboard and new plaster that is still drying out.

The internal timber floor carcase is completely covered using an industrial grade moisture resistant tongue and grooved timber floor boarding. This timber floor boarding creates a solid foundation for any additional floor coverings.

The oak engineered flooring is very hardwearing and easy to clean, making it the perfect flooring choice for an outdoor garden structure. Solid timber pre stained skirting boards are installed to compliment the interior flooring.

Comprehensive Electrical Package

Comprehensive Electrical Package

Each garden room, office or studio is supplied and fitted with a comprehensive electrics package comprising: a consumer unit, electrical sockets, lighting and light switches. The consumer unit controls and protects the power coming into the garden structure.

All that your local electrician needs to do is run power from your house, typically with an armoured cable, and connect to the internal consumer unit.

As standard we will fit four 13amp double sockets in areas of your choice. The double sockets are supplied in a brushed stainless steel finish. Additional double sockets are available on request. All electrical socket wiring is fully concealed out of view within the timber framework.

Internal Lighting

To provide light inside your garden building we install an internal track lighting system. The lighting consists of 4 spotlights on a continuous track. Track lighting is a very practical method of lighting where multiple light fixtures are attached on a track device. The light fixtures can be easily adjusted to distribute light to specific areas inside the building. The track lighting can be installed on the ceiling or along a wall. A light switch is provided and again all wiring is fully concealed out of view in the timber framework.

Additional

Additional Light Fixings

During the timber frame construction and prior to the plaster boarding stage it is very straightforward for our electrician to add in any additional wiring that may be required. You may choose to add some internal wall lights or an external light. We are more than happy to include this additional wiring to ensure our customers achieve their desired results. Optional light fixtures can also be supplied by the customer and installed on site by our electrician at no extra cost.

Heating Options

Oeco offer a range of super slim wall mounted brushed stainless steel panel heaters to heat the inside of your garden building. Each very slim panel heater comes complete with a highly sensitive thermostat and multi programmable 24 hour timer. The wall mounted heater incorporates an innovative wall bracket design which allows the heater unit to hinge forwards for cleaning and decorating. Being economical to run, splash proof and silent in operation these heaters are the perfect choice where space saving and efficiency with style are paramount.

The position of the aluminium 3 door bi-folding sliding door section and the aluminium opening window (and any additional windows required) is at the discretion of the customer. The garden studio bi-folding door and window are supplied double glazed with dark grey aluminium profiles on the outside and the inside.

Additional profile colours are available on request. Each bi-folding sliding door section and window is supplied with heat saving 28mm Pilkinton K argon gas filled double glazed units and warm edge super spacer bars as standard.

Door Security

The aluminium bi-folding doors and windows are designed with security in mind. Link rods are inserted into each door profile's gearing channel prior to joining all pieces together. To provide additional protection, moving C locks are also inserted into this channel. Once the door's four pieces are connected, there is no way to remove the locks. Three sides of the door's handled vents have moving locks, while the remaining side is secured with heavy duty hinges. Toughened glass units are built into the inside to increase security. Once fully installed, the aluminium bi-folding doors and aluminium windows offer superior security and a robust barrier against the natural elements.

The position of the doors and window (and any additional windows required) is at the discretion of the customer. All doors and windows are supplied double glazed with PVC-u oak wood grain effect on the outside and white on the inside. In recent years technology in the double glazed door and window industry has advanced considerably and the latest PVC-u windows are far more energy efficient. All double glazed units are supplied with low-E solar, energy efficient insulated Planitherm clear glass as standard complete with warm edge super spacer bars. (See technical below for further information)

Most glass is manufactured using a hard coating process which often leaves a dusty looking haze across the surface and more of a tint to the glass. Planiterm clear glass uses a different manufacturing process and as such produces an excellent, energy efficient beautiful natural clear finish.

Low-E Solar Glass

Low-E Solar Glass

A low-E glass is a glass with a special coating designed to reflect heat back into the room, thus reducing heat loss. The extent to which low-E glass reduces heat loss is measured by the U-value, the lower the U-value the better the thermal insulation. The Low-E glass windows comply with the latest building regulations with regards to thermal efficiency. These new regulations have been introduced to reduce CO2 emissions associated with heating.

Conventional widows and doors incorporate an aluminium spacer bar situated inside the framework. Our windows and doors incorporate the latest Super spacer warm edge spacer bars. Super spacer is by far the best performing warm edge spacer bar currently available.

2.Reduced condensation.

Foundations

You do not normally need to provide a concrete base for your new Oeco garden building. To save you the expense and inconvenience of providing a complete level concrete base, we use specially designed, concrete pad foundations with heavy duty steel feet. The concrete pads and steel feet are positioned at specific intervals to completely support the timber floor carcase. The steel feet can be adjusted to suit the individual needs of the building or site conditions. This means we can install our garden buildings onto flat or uneven surface. Your garden building is raised off the ground to allow a vented space underneath. This ensures that the structure will not be affected by rising damp.

Traditional Timber Walls & Floor

Traditional Timber Walls & Floor

All our garden buildings are manufactured using traditional timber walls and floor. The walls and floor are constructed using heavy duty solid structural graded timber frames that carry the load of the building. The walls and floor are manufactured using C16 (British Standard) graded structural timber. The 150mm (6 inch) floor timbers are pressure treated and impregnated with Tanelith E wood preservative. Tanelith E pressure treated timber protects against fungal (rot) and insect attack to ensure a long life service. The high grade structural timbers are obtained from well managed, substainable forests.

Roof Panels & Insulation

Our garden room, office or studio roofs are constructed using an interlocking metal roof panel system. Each interlocking metal roof section conprises External colour polyester treated metal skin, rigid thermal insulation core, internal powder coated metal skin, plasterboard and plaster skim. The double metal roof panel is sandwiched with thick rigid thermal insulation. The highly insulated trapezoidal interlocking roof panels span the single pitch, with a 4- 5 degree fall from front to back. Our larger models incorporate an internal solid wooden beam to support the longer roof panels. The edges of the roof panel system are additionally covered with timber cladding.

Room To Breathe

The timber walls are wrapped in an insulated waterproof breathing membrane. This breathing membrane acts like a one way valve and allows natural moisture to escape out of the building - but prevents moisture from entering the building. Our buildings additionally incorporate double vented timber walls allowing air to circulate, enabling the structure to breathe. The first vent allows air to circulate between the outer timber cladding and the breathing membrane. The second vent allows air to circulate between the breathing membrane and the internal Kingspan rigid thermal insulation panels.

To exceed the recommended U-values for building regulations and to provide a truly habitable outdoor garden room all timber walls and floors are insulated using 100mm (4 inch) thick Kingspan rigid thermal insulation panels. Kingspan is the market leader and its products are the most thermally efficient and technically advanced insulation products available today. Although Kingspan rigid thermal insulation is the most expensive form of insulation on the market it has many advantages and increased insulation values when compared to alternative forms of insulation such as mineral or animal fibre. A Kingspan 100mm (4 inch) thick insulation panel is equivalent to approximately 300mm of mineral or animal fibre. In addition by using the Kingspan solid insulation panels your building will not suffer from attacks by mould, fungi, mildew or vermin.

The exterior timber cladding offers a natural attractive finish to the exterior and provides the main protective layer against the elements. The timber cladding combined with the air cavities and internal Kingspan insulation also acts as an additional insulator. All our timber cladding is supplied in superior tongue and groove (T&G) format to ensure complete water tightness. All garden room prices include the Scandinavian Redwood Tanelith E treated timber tongue and groove

cladding as standard. In addition to the Scandinavian Redwood we can also offer you a number of different exterior cladding options. We can also supply any of our garden rooms clad in following timbers: Thermowood, Siberian Larch and Western Red Cedar.

All doors and windows are supplied double glazed with PVC-u oak wood grain effect on the outside and white on the inside. All doors and windows are fitted with low-E solar, energy efficient insulated Planitherm clear glass as standard complete with warm edge super spacer bars.
Each door and window has been designed and tested to achieve the highest levels of security. The patio doors are fitted with the award-winning Yale high security multi-point locking systems to give your garden room maximum protection and to satisfy the requirements for your home contents insurance cover.

A professionally plastered wall gives a warm, elegant surface finish and will also help with sound insulation. A traditionally plastered finish provides additional insulation and contributes to improved energy efficiency.

The internal timber floor structure is completely covered in a 22mm thick industrial grade moisture resistant tongue and grooved timber floor boarding. The 22mm thick timber flooring creates a solid foundation for any additional floor coverings. As standard your garden room will be fitted with an oak effect laminate wooden floor.

All garden rooms come supplied and fitted with a comprehensive electrical package comprising power sockets, lighting and heating. The wiring is concealed out of view inside a special PVC-u skirting and trunking system. We will also install a consumer unit to control the power coming into your garden room In addition to the consumer unit we will install 4 x 13amp double sockets, a wall mounted (timer and thermostatically controlled) convector heater and lighting tacks complete with spotlights. The sockets, heater and lights are all supplied in a brushed stainless steel finish. All that your electrician needs to do is run power from your house, typically with an armoured cable, and connect to the consumer unit.

Once the building has been completed our construction team will ensure that your garden room is cleaned. The outside construction area will be left completely clean and tidy and any rubbish will be removed. You will then be handed the keys to your new garden room.

Mineral or animal fibre insulation is much cheaper (less than a quarter of the price!) and tends to be used by the majority of garden building companies. In addition mineral or animal fibre has a tendency to slip inside the wall cavities leaving pockets or areas without any insulation whatsoever. Unlike thermal insulation panels - mineral and animal fibre insulation products are susceptible to attack from mould, fungi, mildew and vermin.

All our garden buildings are wrapped in an insulated waterproof breathing membrane. This breathing membrane acts like a one way valve and allows natural moisture to escape out of the building - but prevents moisture from entering the building.

In addition all our timber framed garden buildings incorporate double vented timber walls. The first vent allows air to circulate between the outer timber cladding and the breathing membrane. The second vent allows air to circulate between the breathing membrane and the internal rigid thermal insulation panels.
